Tax Planning - Tax Law - Probate Administration
Our goal at Porter, Rogers, Dahlman & Gordon, P.C. is comprehensive estate plans that enable clients to preserve and transfer assets according to their wishes, with the fewest administrative hassles and minimal tax obligations.
Since 1970, our Central and South Texas estate planning attorneys have assisted clients in the structuring of complex wills and trusts. We are one law firm with offices in Corpus Christi, Austin, and San Antonio. Our estates and probate lawyers, Rick Rogers, Scott Duncan, Rick Foster, Patrick P. Rogers, and Terry Dahlman offer extensive legal experience in this area.
Wills and Trusts
Porter, Rogers, Dahlman & Gordon, P.C., drafts a thorough and encompassing will that expresses last wishes and distribution of assets. Components include durable power of attorney, health care power of attorney and advance directives to physicians and family members about life saving or life support measures. A well-designed estate plan will protect assets and provide for loved ones in case of death or incapacity and will minimize ultimate tax consequences.
Toward that end, PRDG is adept at establishing simple and complex trusts for a variety of purposes:
* gifts to multiple generations
* generation-skipping transfers
* charitable lead and charitable remainder trusts
* grantor retained annuity trusts to pass assets free of estate and gift taxes
* revocable trusts ("living trusts") to manage assets while the owner is alive
* trusts for minor children or family members with special needs, including guardianship and conservatorship provisions
Tax Implications of Estate Plans
Effective estate planning includes tax planning. Terry Dahlman is board-certified in Tax Law by the Texas Board of Legal Specialization. Rick Rogers has extensive experience in consulting with clients on the most effective and beneficial estate plan. These attorneys review and assist in structuring wills and trusts to eliminate or minimize federal estate taxes and gift taxes. They also assist the executor or trustee in preparing tax returns for the estate.
Comprehensive Tax Law Advice
The firm’s practice extends to all areas of taxation:
* new businesses on tax consequences of entity formation
* established corporations on income tax, mergers and acquisitions, sales, and purchase transactions
* oil, gas, and mineral companies in all facets of operations
* buyers and sellers in real estate transactions
* participants in 1031 tax-free business exchanges
* succession planning for family limited partnerships
Probate Law
The probate of estates in Texas is not expensive, but can be time-consuming, or complicated when assets trigger federal taxes or the deceased dies without a will. Porter, Rogers, Dahlman & Gordon, P.C., assists the executor or executrix in all probate administration tasks, including locating heirs and distributing assets, liquidating assets, paying debts of the estate. We work with accountants to prepare federal estate and gift tax returns.
An independent administrator operates free of the probate court if the will is properly drafted. We also represent dependent administrators—cases where there is no will, the will is not self-proving (not properly notarized, hastily drafted on a napkin, etc.). PRDG is experienced in probate litigation over will contests.
