Business and Commercial Litigation encompasses those areas of civil litigation mainly concerned with business versus business litigation, including contract disputes and business torts. The section's lawyers have represented companies in the manufacturing, construction, refining, insurance, marine, offshore, transportation, and technology sectors. An important component of the Firm's capability is its document handling resources, located mainly in Houston but available to all offices, which has successfully established the Firm's ability to handle massive document cases.

Labor, Employment and OSHA

The Firm's attorneys that practice in the areas of labor and employment law routinely advise, arbitrate, and litigate on behalf of employers and employer groups in the union setting. With respect to ERISA, our attorneys advise and litigate on behalf of employers, benefit plans, and insurance companies on issues ranging from plan design, to claims for benefits, to allegations of breach of fiduciary duty. In addition, the section advises employers and represents employers in litigation involving all types of disputes and issues that arise in the employment relationship, including matters arising under Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Fair Labor Standards Act, the Family and Medical Leave Act, Employment Retirement Income Security Act, the National Labor Relations Act, and the Texas Labor Code. The section members also address common law claims frequently asserted along with allegations of wrongful termination, such as slander and intentional infliction of emotional distress. The members also represent clients in matters before the Equal Employment Opportunity Commission, the Texas Commission on Human Rights, the National Labor Relations Board, and the Texas Workforce Commission. Section members are frequent speakers at seminars for lawyers and human resource managers, and prepare and present training seminars tailored to the needs of the individual client, such as new employee orientation or periodic compliance training. Members of this Section defend insurers and self-insured employers for group welfare plans, including health, life, and disability plans.
